AED Machinery Hire Pty Ltd operates within New South Wales and provides machinery and equipment for hire. By hiring equipment from AED Machinery Hire Pty Ltd, you agree to the following terms and conditions:
1. Equipment Hire
The equipment hired includes, but is not limited to, various machinery from AED Machinery Hire Pty Ltd. Specific models will be listed on your invoice.
We do not guarantee that the equipment is suitable for your intended purpose.
2. Definitions
Hirer: The customer who hires the equipment, including their employees, representatives, and assigns.
Date Out: The date when the equipment is rented, as specified in the hire agreement.
Equipment: The machinery and any accessories provided under the hire agreement, including replacement parts if necessary.
3. Hire Charges
Charges apply from the Date Out until the equipment is returned. Equipment returned before 7am will not incur an additional hire charge for that day.
Additional charges may include delivery, equipment operating costs (such as fuel), and a refundable bond of $200.
You authorise AED Machinery Hire Pty Ltd to deduct all hire-related costs from the payment method you provide.
4. Termination
The hire agreement terminates when the equipment is returned or collected by AED Machinery Hire Pty Ltd.
We reserve the right to terminate the hire agreement if you breach the terms and fail to remedy the breach within 12 hours of notification.
5. Your Obligations
You are responsible for the equipment during the hire period. You may not allow others to use, re-hire, or possess the equipment without our written consent.
Equipment must be returned by 7am on the termination date with a full tank of diesel. Failure to do so may incur additional charges.
You must ensure the safe and lawful operation of the equipment by trained personnel, who must wear appropriate safety gear and avoid the use of drugs or alcohol.
You are responsible for the proper maintenance of the equipment, including cleaning and fueling, at your own cost.
Equipment must be stored securely and protected from theft or damage.
6. Breakdowns
In the event of a breakdown, you must stop using the equipment immediately and notify AED Machinery Hire Pty Ltd. Do not attempt repairs without our written consent.
AED Machinery Hire Pty Ltd will repair or replace faulty equipment as soon as possible, and no hire charges will apply for the time during which the equipment is unusable.
7. Loss, Theft, or Damage
If the equipment is lost, stolen, or damaged due to your negligence, you are liable for:
A $2000 insurance excess if a claim is required.
Costs to recover and repair the equipment, or its full replacement value.
Hire charges for the period during which the equipment is being repaired or replaced.
8. Privacy
We comply with the National Privacy Principles and may collect personal information such as your name, address, and payment details. This information is used to provide our services, assess creditworthiness, prevent theft, and maintain a client relationship with you.
9. Force Majeure
We are not responsible for delays caused by events beyond our control, such as natural disasters, strikes, or government regulations. However, you remain liable for equipment lost, stolen, or damaged during the hire period due to your negligence.
10. Equipment Ownership
AED Machinery Hire Pty Ltd retains ownership of all equipment at all times. You may not sell, sub-let, or otherwise deal with the equipment in any way.
